COLLECTIONS POLICY
By placing an order with Champagne and Ink for a Collections Design, it assumes that you have read and agree to the following.
BASIC TERMS AND CONDITIONS
PAYMENT. Payment is due in full at the time of ordering. Orders are considered non-refundable once design work has commenced. If you need to cancel your order before design work has started, you will be refunded in full, minus a $185 processing fee. Invitations will NOT be printed and / or shipped if there is any outstanding balance due. Champagne and Ink, LLC is not responsible for any delays in mail date or delivery date as a result of non-payment.
If any additional design work is requested, you understand that you will be charged a rate based on the additional work requested. And that any additional work may require more time than originally estimated to complete.
ORIGINAL ARTWORK. All proofs, design elements, sketches, proposals and quotes are the intellectual property of Champagne and Ink, LLC and may not be shared, copied or imitated by you or any other person. Exceptions are made only for persons directly involved with your wedding; eg: wedding planner, florist, parents, significant other.
Champagne and Ink, LLC owns all copyrights in any and all work(s) created or produced pursuant to federal copyright law (Title 17, Chapter 2, Section 201-02 of the United States Code), whether registered or unregistered. Any and all products, whether tangible or intangible, produced or created in connection with, or in the process of fulfilling any Collections order, are expressly and solely owned by Champagne and Ink LLC and may be used in the reasonable course of our business. We reserve the the right to also use images, design elements, illustrations, calligraphy, etc. from any portion of the work for portfolio or marketing purposes. You may request that we delay posting photos or imagery publicly until after your event date.
LICENSING RIGHTS & FEES. The rights granted to you with your Collections order are for the usage of the Final Art in its original form only. You may not reproduce or reuse this Final Art in any form without prior written consent from Champagne and Ink, LLC. Additionally, you may not crop, distort, manipulate, reconfigure, mimic, animate, edit, extract portions or intentionally alter the Final Art.
Final Art CANNOT be printed by you, significant other, planner, or any other third party other than Champagne and Ink, LLC. This includes crests, stationery artwork, motifs, patterns, illustrations, and design elements. An exception will be made if you purchase an extended license of artwork, please email to inquire.
By placing a Collections order you understand that any unauthorized use of design elements will result in an invoice from Champagne and Ink for the applicable licensing fees accrued, all subsequent invoices are payable within seven (7) days of receipt to avoid Champagne and Ink, LLC referring the unpaid amount to collections. You are responsible for any fees from unauthorized artwork usage.
LIABILITY Champagne and Ink, LLC is not liable for any quality defects, damage, injury or other incident which occurs from, in, or with delivered product, except to the extent caused by our negligence or willful misconduct.
FORCE MAJEURE No Party shall be liable in damages or have the right to terminate your order for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including, but not limited to, acts of God (such as hurricanes, earthquakes, flooding), fire, epidemics, Government restrictions (including the denial or cancellation of any export or other necessary license), wars, terrorist acts, insurrections and/or any other cause beyond the reasonable control of the Party whose performance is affected. Should your Wedding be cancelled, postponed or otherwise adversely impacted as a result of a force majeure event, there shall be no refunds for payments already received by Champagne and Ink, LLC, but we will use all reasonable efforts to work with you to produce the Final Art at a later date if necessary, subject to our availability. Additional fees may be incurred and due to us and/or Wedding vendors as a result of a rescheduled event.
SHIPMENT & DELIVERY We will safely package and seal all products. We ship Wedding Invitations via United States Postal Service (USPS) Priority Mail, unless otherwise requested. By placing a Collections order, you understand that we are not in control of the USPS and that we are NOT responsible for lost or damaged items. You also understand that holidays, weather circumstances, and USPS' local branches may effect the ship and / or delivery date, despite the estimated delivery date generated by USPS. You also understand that Invitations occasionally incur additional postage because of their weight, or due to the shape of the finished piece, you are responsible for any additional postage beyond our estimation. PICKUP You may pickup items locally from us at agreed upon time if you do not wish to have your Invitations shipped to you. If pickup is preferred, we ask that you schedule a pickup date at the time of final design approvals.
LETTERPRESS / ONE OF A KIND DISCLAIMER All of our pieces are carefully handmade, one piece at a time. Because of this, there may be slight variations in the product. The piece you receive may not be identical to the one before it. Those small variations, which may be slight color and/or paper texture, all add to the look and feel of each item. These reasons should not be misconstrued as flaws or defects. We will only consider replacing or refunding products if we feel that our product is technically defective.
